Vacation Recalls The Legendary VACATION By Vacation Black Label Scented Candles Due To Fire And Laceration Hazard

The U.S. Consumer Product Safety Commission (CPSC) recently announced the recall of Vacation scented candles. According to the recall, the flame can burn too high causing the glass container to break. This poses a fire risk and laceration hazards.

Consumers are advised to immediately stop using the recalled candles and contact Vacation Inc. to receive a full refund of $42. Consumers should visit https://vacation.inc/candlerecall for instructions on how to register for the recall, upload a photo of the candle with a note indicating the date and customer initials, indicate whether the refund should be in the form of a check or ACH electronic payment, and confirm disposal of the candle in the trash. Vacation Inc. is contacting all known purchasers of the candle directly.

While no injuries have been reported, the firm has received seven reports of the flame burning too high and the glass container breaking.

The products were sold by Amazon.com, Ulta.com, and several beauty and fashion stores throughout the country from November 2023 to September 2024.

Exploding candles and product liability lawsuits 

Halpern, Santos, & Pinkert wrote about “an exploding candle lawsuit” filed against Walmart. In this case, the plaintiff claimed that she suffered second-degree burns as a result of an “exploding” candle she purchased from Walmart. According to her suit, she was burning the candle for about an hour before she noticed that the flames were burning too high. It did not appear to her as if the fire was solely coming from the wick. She believed that the wax itself had caught fire. When she tried to transport the candle to the sink, it allegedly “exploded” resulting in serious burn injuries.

According to the plaintiff’s lawsuit, the candles contained improper labeling and failed to warn consumers about the inherent dangers. According to the product’s label, customers were directed not to allow the candle to burn down to less than half an inch as it could cause a fire hazard. The label further wants customers not to burn the candle for more than 4 hours at a time as that could cause the glass to shatter. The label also warns customers not to allow flames to reach the glass. The label did not warn customers about the risk of excessive flames or explosions.

Such lawsuits are filed under a theory of product liability. Product liability lawsuits make three sorts of claims. You can claim that the product is intrinsically defective and that led to a serious injury. You can also claim that the product had a manufacturing defect that rendered it defective. Lastly, you can claim that the company failed to warn consumers about an inherent danger of the product. In the case of the Walmart candles, the suit was filed under a theory that Walmart and the manufacturer failed to warn consumers about an inherent danger.
