Camping Cooking Pots Recalled Due To Scald Hazard
The U.S. Consumer Product and Safety Commission recently announced the recall of 60,655 Cascade Design cooking pots due to a burn and scald hazard. These pots were sold at outdoor cooking stores across the U.S. between January 2008 and October 2023. They were priced between $40 and $290.
Cascade Designs is recalling the cooking pots because of the potential for the handle to loosen or detach resulting in burn and scald hazards as hot liquid and food spills out of the pot. The company has already received 22 reports of the handle loosening. Two customers complained of burn injuries.
The Consumer Product Safety Commission recommends that customers stop using the cooking pot immediately and contact Cascade Designs for information on getting a refund or replacement.
Potential product liability lawsuits
When you purchase a product, you expect it to work as advertised. Every manufacturer has a duty of care to ensure that their products are safe for use. When they fail in this duty of care, and their customers are injured as a result of that failure, the customer can file a product liability lawsuit against the manufacturer and the retailer who made the product available to the public.
In the case mentioned above, customers reported that the handle on their cooking pot was defective, potentially leading to burn injuries. In at least two cases, customers reported burns from the collapse of the defective handle. In these cases, customers could have sustained severe injury as a result of hot food or liquid pouring out onto their hands or body.
In burn injury lawsuits, it is typical for the plaintiff to claim that they have permanent scarring as a result of the accident. Permanent scarring is compensable damage under personal injury law. You can sue a manufacturer for disfigurement related to burn injuries. It is unclear how extensive the injuries that the customers sustained are, in this case, but it’s reasonable to assume they could have suffered second- or third-degree burns as a result of the defective cooking pot.
In these cases, a customer is eligible to recover damages related to their medical expenses. Often, the customer would have to go to the hospital to treat the burn injury and would incur the expense of hospital bills related to their treatment. It’s also possible that the injury is extensive enough to prevent them from working for a period of time. The customer would be eligible to recover damages related to their lost wages. Finally, the customer may have suffered permanent scarring as a result of the burn injury or permanent mobility issues. This would impact their quality of life and be compensable under pain and suffering damages.
