Clorox Company Sued Over Exposure To Bacteria
A recent product liability lawsuit has been filed against The Clorox Company after one of their customers was exposed to a dangerous bacteria, Pseudomonas aeruginosa, and suffered injuries as a result of that exposure. According to the complaint, the Pine-Sol cleaner was purchased around June 2022 when the plaintiff was exposed to an unsafe amount of Pseudomonas aeruginosa which in turn led to severe health complications. The lawsuit contends that the product was recalled by The Clorox Company in October of 2022 due to the presence of this bacteria.
The Consumer Product Safety Commission reported that testing identified the bacteria in certain recalled products including those produced between January 2021 and September 2022. Clorox produced around 37 million recalled products during that period.
According to the lawsuit, The Clorox Company was negligent in the manufacture of the product which led to contamination resulting in the plaintiff’s injuries.
What is Pseudomonas aeruginosa?
Pseudomonas aeruginosa infection is the most common type of Pseudomonas bacterial infection in humans. It is generally found in moist places in the environment and can also be found in wet areas of your home like bathtubs and sinks. The infection can be challenging to get rid of because it is antibiotic-resistant. While most people with healthy immune systems can fight off the infection easily, those with compromised immune systems are at greater risk for serious injury or even death.
It’s unclear from the article how severely infected the plaintiff was by the bacteria. Nonetheless, the defendant company is responsible for her injuries.
Product liability and bacterial infection
In this case, some sort of manufacturing defect occurred causing the Pine-Sol product to become contaminated with the bacteria. Companies are strictly liable for any injuries that their product causes during the normal use of the product. In this case, the plaintiff was infected by a serious bacterial infection that is resistant to antibiotics. The bacteria can infect the blood, lungs, skin, ears, and eyes.
Depending on the extent of her injuries, she would be entitled to recover significant damages from the company that manufactured the product. Eligible damages include her medical expenses, lost wages, and reduced quality of life.
Bacteria can invade and contaminate all sorts of consumer products. This includes make-up, food, and even cleaning products. When this occurs, an investigation is undertaken and generally traced back to unsanitary conditions at the manufacturing plant.
Product liability lawsuits can be filed on three grounds. Those are intrinsic defects, manufacturing defects, and failure to warn. In this case, the plaintiff is alleging that a manufacturing defect resulted in contamination of the product she purchased which resulted in her subsequent infection from the bacteria.
