CPSC Announces The Recall Of 1.2 Million Good Earth Rechargeable Integrated Lights

The U.S. Consumer Product Safety Commission (CPSC) recently announced the recall of more than 1.2 million Good Earth Rechargeable Integrated Lights. According to the CPSC, the lights are being recalled due to having started multiple fires. One of these fires turned deadly. The CPSC says that the product’s battery can overheat and ignite its plastic casing.

One person died, and another was treated for smoke inhalation when the light overheated and caused a fire in their home last year. The company has heard nine additional reports of the product overheating, including six that resulted in fire and property damage. After investigating 10 reports of the lights overheating, Good Earth “removed the lights involved in these incidents from sale to the public in January citing “an abundance of caution.” The recall was only announced recently because of the recall process involved in recalling a consumer product.

Good Earth announced that it was working in close coordination with the CPSC to conduct an investigation, submit the results of the investigation, and develop an appropriate replacement program.

Wrongful death lawsuit incoming 

At least one person died in a fire alleged to have been caused by the defective lights. This individual’s family will have a solid wrongful death lawsuit on their hands. While the wrongful death lawsuit won’t replace their loved one, it will help hold the company accountable for manufacturing a defective and dangerous product and then entering it into the stream of commerce where it caused at least 10 fires.

Battery fire lawsuits are not uncommon. Lithium-ion battery fires can be quite dangerous and difficult to put out since they burn so hot. There have been reports of cars spontaneously bursting into flames and smaller consumer products, like cell phones, that use lithium-ion technology have also been known to cause burn injuries. While such incidents are becoming rarer, problems with lithium-ion batteries still occur. In this case, you have a product which can burst into flame causing substantial property damage, fire hazard injuries, and even death.

The other injured party can also file a lawsuit against the company. This individual was treated for smoke inhalation. This individual incurred medical expenses and suffered the pain and anguish of having inhaled smoke to the extent that it created a medical problem for them. They are due compensation from the manufacturer of the company.

Design defects in product liability 

There is clearly some form of design defect happening with these lights that cause the battery to overheat and ignite. A design defect is one of three theories of liability you can pin on a company that manufactured a dangerous product causing injury. The plaintiff alleges that the product was designed defectively causing it to become dangerous to the public and ultimately causing injury or death.
