CPSC Recalls Tumblers With Metal Straws Due To Laceration Hazard

The U.S. Consumer Product Safety Commission recently announced the recall of about 60,000 tumblers with metal straws due to the risk of cutting yourself on the metal straw. According to the recall, the metal straw inside the tumbler can cut your mouth or fingers, posing a laceration hazard. The company announced that it would refund or replace the item as part of the recall.

Consumers are advised to immediately stop using the recalled metal straw that comes with the tumbler and contact HALO, the manufacturer, for instructions on how to receive a refund in the form of a $15 gift card. The original tumbler and metal straw must be returned to HALO to receive the refund. HALO says that proof of purchase (or a receipt) is not required to receive a replacement or refund. HALO will provide a prepaid shipping label for the recalled units. Consumers are advised not to return the recalled units to Wawa stores, where the item was exclusively sold.

HALO has received four reports of consumers cutting themselves on their hands or mouths due to the laceration risk presented by the metal straw. Wawa stores can be found in Florida, among other states.

The dangers of metal straws

Metal straws pose a serious laceration risk, especially to children. In 2016, Starbucks recalled 2.5 million metal straws after receiving reports of small children cutting their mouths on them. Starbucks later issued a statement saying that consumers should not allow children to use stainless-steel straws.

In 2019, a British woman died after she was impaled by a metal straw during an accidental fall. In one case, a 4-year-old boy was seriously injured after a metal straw punctured the artery in the boy’s neck, cutting off blood supply to part of his brain and allowing blood to gush from his mouth after every heartbeat.

Moments earlier, the boy had been sitting on the porch ledge of his family’s home, sipping a yogurt drink when he lost his balance and fell. The ensuing injuries nearly killed him. The force of the fall sent the metal straw in his mouth through his tongue and into his throat, piercing the right carotid artery.

Product liability lawsuits

If you sustained a serious injury as a result of a metal straw, you may be entitled to file a product liability lawsuit against the manufacturer and retailer who made the product available to the public. In these cases, you can argue that the metal straw was unreasonably dangerous, posing a potential laceration hazard. HALO received multiple reports of adults injuring themselves with these metal straws.
