Glass Coffee Mugs Recalled After Causing Several Consumer Injuries
Recently, the U.S. Consumer Product Safety Commission reported on a recall of 580,000 glass coffee mugs due to injuries suffered by customers including burns and lacerations. The injuries occurred when the cups broke or cracked after being filled with hot liquid. According to the recall notice issued by the CPSC, JoyJolt-branded “Declan Single Wall Glass Coffee Mugs” can crack or break when filled with hot liquids.
At this point, the CPSC indicated that there have been 103 incidents of these glasses breaking at the base. This has resulted in 56 injuries. The injuries include 35 reports of burns from spilled contents of the mug and 21 cuts. Seven of those injuries required medical attention such as surgery and stitches.
The 16-ounce coffee mugs were distributed by a New York-based company MM Products Inc. They were sold only at the company’s JoyJolt website as well as Amazon.com from September 2019 through May 2022 in sets of 6 for between $20 and $25. The coffee mugs have a model number of JG10242 that can be found on the side of the product’s packaging and order confirmation.
Consumers are being urged to immediately stop using the products and contact MM Products for a full refund.
Product liability lawsuits
Product liability lawsuits are filed under three theories of liability. The theory of liability that is relevant to this case is design defect. If a product has a serious design defect that renders it dangerous to the public, the company is liable for any injuries that the product causes. In the case mentioned above, you have a glass coffee mug that is prone to cracking when it is exposed to hot liquids. Several individuals have sustained burn and cut injuries as a result of the coffee mug cracking while filled with hot liquid. This is an actionable claim. At least 56 individuals have actionable claims against the company under the design defect theory of product liability.
Plaintiffs who file a lawsuit against MM Products would claim that a design defect in the coffee mug allowed it to crack when it was exposed to hot contents. The mug cracked resulting in either burn or cut injuries to areas of the body like the hands, chest, and belly. Burn injuries tend to leave permanent scarring. Permanent scarring is a handsomely compensated personal injury because you have to live with it for the rest of your life and it impacts your ability to feel good about your body, thus decreasing your quality of life. The plaintiffs would be able to sue for medical expenses, any lost wages, and reduced quality of life (pain and suffering) damages.
