Magnetic Building Sticks Sets Recalled Due To Ingestion Hazard And Violations Of Federal Regulations For Toy Magnets

MagneticSticks

The U.S. Consumer Product Safety Commission has announced the recall of Elongdi Magnetic Building Sticks Sets. According to the recall, the recalled magnetic building stick sets violate the mandatory federal regulation for magnet toys and pose an ingestion hazard. When high-powered magnets are swallowed, the ingested magnets can attract one another or another metal object and become lodged in the digestive tract. This, in turn, can result in perforations, twisting and/or blockage of the intestines, infection, blood poisoning, and death.

The recall involves multicolored magnetic building stick sets with 130 pieces. The sets contain 100 magnetic sticks that are made of plastic and metal. The sets are sold in a box with the “Elongdi” logo and the words “Magnetic Sticks” on the front and back of the box. The set includes 30 steel balls.

Consumers are advised to immediately stop using the recalled magnetic stick sets, take them away from children, and contact Elongdi to receive a pre-paid label to return the recalled magnetic building sticks for a full refund. Amazon is also notifying all known purchasers directly.

At present, no injuries have been reported. However, the CPSC estimates that 2,400 magnet ingestions were treated in hospital emergency departments from 2017 through 2021. The CPSC is aware of eight deaths related to magnetic toys since 2005 through 2021 involving the ingestion of hazardous magnets. Two of these were outside of the United States.

The magnetic building sticks were sold exclusively by Amazon.com from March 2024 through June 2024 for about $20.

Magnetic toy lawsuits

The CPSC recently drew attention to serious concerns regarding small, powerful magnets found in certain toys. With eight reported deaths and over 2,400 emergency room visits, these toys pose a serious ingestion hazard to children. If ingested, the magnets can cause severe internal damage, including intestinal perforation, blockage, blood poisoning, and eventually lead to death. The risk grows exponentially when these magnets are swallowed alongside other metal objects since they can attract each other inside the body, causing further internal damage.

In response to these dangers, the CPSC approved a new safety standard for small magnets. The safety standard requires that magnetic products be too large to be swallowed or weak enough to minimize internal injury risks if ingested. Despite these regulations, many companies still sell products that don’t conform to the regulations. The aforementioned recall is an example.

If a child suffers a serious injury because they ingested a magnet that didn’t conform to the CPSC’s safety standards, the company that manufactured the product can be sued for damages. Damages would include medical expenses and pain and suffering for parents of children who ingested the illegal magnets.
