Mr. Christmas Recalls Wireless Decorative Tree Light Controllers Due To Fire Hazard

The U.S. Consumer Product Safety Commission recently announced the recall of Mr. Christmas’s wireless decorative tree light controllers. The controller is a device that allows you to turn your Christmas lights on or off from a centralized location. The decorative controller contains two parts: a lever or a switch that can be pulled to turn the holiday lights on or off, and a separate white receiver that plugs into an outlet and into which the holiday tree lights are plugged. The controller is sold at Walmart, Target, and Cracker Barrel.
According to the recall, the wireless receiver that plugs into the outlet can overheat, posing a fire hazard. Consumers are advised to immediately stop using the product and return it to their place of purchase to request a refund.
The CPSC says that Mr. Christmas has received 10 reports of the receiver overheating, including one report of a fire.
Product liability lawsuits and consumer product recalls
Consumer product recalls are the first step in the process of keeping Americans safe from defective or dangerous products. However, just because a company has complied with the CPSC’s recall process, it doesn’t mean that they aren’t liable for injuries or property damage that occurs because of their defective product. In fact, these companies are still liable if their product causes injury or property damage, even if the product has been recalled.
Who can I sue in a product liability lawsuit?
You can sue any company that was part of the supply chain that had the defect. This includes retailers like Walmart and Target. If you purchased a Mr. Christmas decorative light controller from Walmart, both the company that manufactured the product (Mr. Christmas) and the company that made the product available to the public can be held liable under our state’s rules of product liability.
Burn injury lawsuits
Burn injury lawsuits involving consumer products are relatively common. When it comes to burn injuries, numerous products can cause them. Burn injuries are unique insofar as they leave ugly permanent scarring on the skin. This is known as a mutilation injury. The product causes a cosmetic deformity to otherwise healthy skin. Burn injuries can also cause nerve damage and can easily become infected. Common products that cause burn injuries include:
- Pressure cookers
- Candles
- Any product containing a lithium-ion battery
- Cars, trucks, and other vehicles
- Christmas tree light controllers
