Onasti Toddler Tower Stools Recalled For Serious Fall And Injury Hazards

ChildStepStool

The U.S. Consumer Product Safety Commission (CPSC) recently announced the recall of Onasti Toddler Tower Stools. The recall involves Onasti-branded toddler stools. The plastic, foldable, triangular shaped tower stools were sold in beige or white, blue or gray, green, gray or white, and light blue and pink. They measure roughly 25 inches long, 24 inches wide and 32 inches tall. They have handles and an adjustable platform that can be raised or lowered from two to three steps. The Onasti logo appears on the warning label on the side of the stool.

According to the recall, the stools can collapse or tip over while in use, posing serious fall and injury hazards to children. The CPSC is recommending that consumers immediately stop using the recalled stools and store them away from children until repaired. Those who purchased the stools can contact Blissful-Time to receive a free repair kit, including shipping. The repair kit consists of two steps, one base, and one guardrail. Blissful-Time is in the process of contacting all known purchasers directly.

Blissful-Time has received four reports of the stool collapsing or tipping over. This includes two injuries, with one causing bruising and the other causing a brain injury to a toddler.

The allegedly defective stools were sold exclusively by Amazon.com.

Brain injuries and product liability lawsuits

Individuals who are injured by the defective consumer products can file personal injury lawsuits under a theory of product liability if they are injured by the product. In this case, an individual person purchasing a toddler’s stool would have a reasonable expectation that the stool would function in its normal capacity. If the stool is prone to tipping over, however, it could cause serious injury to a toddler. Already, one toddler suffered a brain injury as a result of a fall from the stool. And another suffered serious bruising. While it can be difficult to file a lawsuit if the only injury you received was a bruise, you can and should file a lawsuit if you suffered a traumatic brain injury as a result of a defective product.

Both manufacturers and retailers are responsible for ensuring the safety of products they put into the stream of commerce. When they fall in this regard, members of the public can be seriously injured as a result of their negligence. One of the few ways to hold companies accountable for their conduct is by filing a personal injury lawsuit against the company. In this case, both Amazon and Blissful-Time would be on the hook for a personal injury lawsuit if one were to be filed against them.
