OneWheel Electric Skateboard Causing Severe Injuries To Riders

Numerous personal injury product liability lawsuits have been filed against Future Motion Inc. over their product, OneWheel. The OneWheel is an electric skateboard product which contains one large wheel in the center of the board and is powered by an electric motor. According to a growing number of product liability lawsuits, the Onewheel contains an alleged defect that causes the skateboard to stop suddenly and unexpectedly in mid-motion. This can cause the rider to be propelled off the board and sustain serious injuries.

Recent updates on OneWheel product liability lawsuits 

One of the plaintiffs who is filing a product liability lawsuit against Future Motion Inc. has recently filed a motion to amend their complaint to include claims for punitive damages under California law. The motion also seeks to add Future Motion MFG LLC as a defendant to the case. This particular lawsuit revolves around alleged defects of the OneWheel Pint X.

Future Motion Inc. strongly opposed the amendment. They argued that the case should be governed by the Washington Product Liability Act, which precludes punitive damages. They further argued that even if California law were applicable to the case, the plaintiffs have not provided specific factual allegations to justify punitive damages. Future Motion argues that adding its manufacturing subsidiary as a defendant would be useless since the plaintiffs have not identified any specific manufacturing defects.

The plaintiffs, on the other hand, contend that Future Motion acted with malice by not initiating a recall of the product sooner and failing to adequately warn consumers of a known danger.

Future Motion likely doesn’t want punitive damages before the jury because of the manner in which they responded to the U.S. Consumer Product Safety Commission. By the time Future Motion had initiated a recall, four people had already died and several others suffered severe injuries such as concussions, paralysis, and fractures. These injuries all occurred between 2019 and 2021. The recall notice stated that OneWheels can stop balancing if their limits are exceeded leading to a crash.

Design defects in product liability cases 

The plaintiffs are alleging that the OneWheel has a design defect that causes it to suddenly stop while the skateboard is in motion. This represents a serious danger to riders who can be propelled from the motorized skateboard into traffic or onto the hard pavement.

A recent product liability lawsuit filed by a plaintiff in Washington marks the type of allegations you will find in these lawsuits. According to the plaintiff, he was riding his OneWheel when the board suddenly halted, propelling him off, and onto the ground. As a result of the sudden stoppage, the plaintiff suffered a broken elbow and fractured forearm for which he required surgery.
