Target Recalls Chuckle & Roar Ultimate Water Beads Activity Kit After Baby Dies
More than 50,000 water beads toys sold at Target are being recalled amid a choking and ingestion hazard. According to the recall, if a water beat is ingested, it can expand in the body and pose a risk of choking or intestinal obstruction, resulting in vomiting, severe discomfort, dehydration, and a risk of death to the child.
Water beads are small, but grow in size when they are exposed to water or other forms of moisture. They pose a serious risk of ingestion to young infants and toddlers. Once the water bead has been swallowed, it can grow in size by a factor of 150 to 1500 times larger than it was prior to ingestion. The toys were sold exclusively at Target.
Target toy injuries can occur. When they do, both the manufacturer of the product and the distributor can be held liable for any injuries or deaths that occur. In this case, the family has not yet announced whether or not they will file a wrongful death lawsuit against Target and Buffalo Games who distributed and manufactured the dangerous product.
The recall was issued in September of 2023.
Suing Target for toy injuries
Target can be sued for placing dangerous products into the stream of commerce. When a child dies due to a defective toy, Target is strictly liable for the death. That means that the plaintiff need not prove negligence to win their case. Both the distributor and the manufacturer can be held liable for injuries that occur due to Target toys.
Target is likely to face a wrongful death lawsuit filed by the family of the infant who was killed by the water beads toy. The wrongful death lawsuit will allege that the product was intrinsically defective and posed an obvious risk to younger children if the beads were ingested.

The second theory is that a manufacturing defect made the product unreasonably dangerous. The third theory is that the product manufacturer failed to warn customers about a potential danger.
In the case mentioned above, the potential plaintiffs can allege that the product was both intrinsically defective and that the company failed to warn customers that the product was extremely dangerous if swallowed.
