Veyer Recalls WorkPro Office Chairs Due To Fall Hazard

The U.S. Consumer Product Safety Commission recently announced the recall of Veyer WorkPro Office Chairs due to a fall hazard. According to the recall, the bolts that connect the back of the chair to its base can fail, posing a fall hazard to users. Consumers are advised to immediately stop using the recalled chair until it is repaired. They are further advised to contact Veyer to receive a free repair kit, including shipping, and installation instructions. The repair kit consists of a back bracket, three bolts, an Allen wrench, and a decorative cover. Veyer is contacting all known purchasers of the WorkPro Office Chair directly.

The recall states that Veyer has received seven reports of individuals falling off the chair. Two minor injuries were reported.

The chairs were sold at Office Depot, OfficeMax, and online at Amazon.com, Walmart.com, and eBay.com as well as other websites.

Defective chair lawsuits 

Chairs should be sturdy enough to hold the user’s weight. When a user sits on a chair they recently purchased and the back of the chair comes off, they can sustain several serious injuries related to the ensuing fall. In this case, two users sustained injuries as a result of falling off the chair. Depending on how significant those injuries are, they would be entitled to file a product liability lawsuit against the manufacturer and retailer who sold them the chair.

Defective chair lawsuits fall into two categories: Premises liability claims and product liability claims. If you recently purchased an unstable chair and you fell, causing injury, you would file a product liability claim. If you were at a bar or restaurant when a defective chair broke and caused your injury, you would have a premises liability claim.

To win a product liability claim after you have been injured by a defective chair, you must establish that the chair was intrinsically defective or had a manufacturing defect that rendered it unstable for human use. You must also establish that you used the chair in a manner that could be readily anticipated by the manufacturer. You can’t, for example, hurl yourself onto the chair or cause your injuries by negligence. If you weren’t negligent, you can file suit against both the manufacturer of the defective chair and the retailer who sold it.

To win a premises liability claim, you must establish that the proprietor either knew or should have known about the defective chair. Foreseeability is an element of any premises liability claim. The defendant must have known about the defective chair or they should have known about it because it was on their property for an extended period of time.
